Privacy Policy

 

1. Information Collected:

1.1. We will collect personal information of the User. While some User information has to be mandatorily provided, others are optional and certain portions of the information will remain private and some will be displayed to other users; We shall always let the User know which is which. Additional information may be gathered during subsequent use of the Platform by the User, whenever the User chooses to provide it.

1.2. Certain mandatory information will be collected at the time of registration on the Platform which is required to enable the User to login to the Platform and for Us to:

(i) verify the User’s identity; 

(ii) determine the User’s eligibility for accessing the Platform.

In order to use the facilities and services available on the Platform, the User may be required, from time to time, to provide certain additional personal information after registration on the Platform, which information shall be collected only upon receiving the User’s express consent. We may also automatically receive and collect certain anonymous information in standard usage logs through the web server, including mobile-identification information obtained from the equivalent of  cookies; sent to the Platform, including mobile network information, standard web log information, traffic to and from our Platform, tracking inside the Platform and any other available information, from:

1.4.1.1 an IP address, assigned to the device used by the User;

1.4.1.2. the domain server through which the User accesses the Platform and the functions and features therein; and

1.4.1.3. the type of device used by the User (“Device”).

1.5. The User may choose to provide Us with access to certain personal information stored by third parties. We will have access to such information to the extent allowed by the User’s privacy settings on that site and the User’s specific authorization. In the event the User associates a User account managed by Us with an account maintained with any third party to enable Us to access certain information maintained in such third party managed accounts, the User agrees that We may collect, store and use such information in accordance with this Privacy Policy.

1.6. After obtaining the User’s specific consent to allow the Platform to access the User’s SMS inbox, we may collect relevant information from text messages (SMS) received by the Users from providers of services and/or products, that will enable us to provide better access of the Platform to the Users. We will only access business messages that originate from alphanumeric senders.

1.7. In order to enhance our ability to provide valuable services and experiences to the User, We may:

(i) automatically receive, collect and analyse your location information which may be accessed through a variety of methods including, inter alia, GPS, IP address, and cell tower location; and

(ii) collect information pertaining to your Device and your usage thereof, including, inter alia, the names of the other applications on your mobile Device and how you use them, information about your Device, and information about your use of features or functions on your Device.

1.8. Our Platform is directed to be used by adults only. If You are not an adult, while You may look at our Platform, You should not make a purchase, register, or submit personal data to Us. We or our associates /affiliates do not knowingly collect information from minors.

1.9. We may also be working closely with third parties (including, for example, business partners, technical sub-contractors, analytics providers such as Google Analytics, search information providers) and may receive information about You from such sources.

1.10. Data added by You. We collect the information that You actively input into the Platform:

1.10.1. Account data: We collect the data you provide to us when you create or update your account, or while making purchases from the Platform as a guest. This includes your name, phone number, email ID, delivery address (which may be your home or office address) date of birth, unique User ID, password (as applicable). We may require you to share further data on a later date to confirm the veracity of your information or pursuant to any additional features added to the Platform. We may also require you to share data pertaining to gender, sexual preference and sexual orientation on the Platform to access certain services, provide you with Information and content, or as part of surveys. However, this shall not be mandatory and failure to provide such personal data shall only affect your ability to access such services, information or content.

1.10.2. We collect the data you provide to us when you place an order for Products on our Platform. This includes credit or debit card details, e-wallet details and banking details.

1.10.3. Feedback and other data: We collect and record:

(a) any emails you write to us;

(b) the calls you make to our call centers, customer service personnel;

(c) any data you submit to us on social media and other modes of communication/platforms

(d) data you input when you participate in our referral programs or use any discount codes offered by us; and

(e) feedback or comments you provide to us on the Platform, including any crash reports and lag reports generated by you.

1.11. Data collected from use of Platform. We collect the following data generated owing to and pursuant to your use of the Platform:

1.11.1. Platform usage data: We collect data on your interaction with our Platform, i.e., Platform access dates and times, features or pages viewed, crashes and other system activity, type of browser used to access the Platform, and third-party sites or services used before or in the course of interacting with our Platform.

1.11.2. Device data: We may collect data about the devices used to access our Platform, including the hardware models, device IP address, operating systems and versions, software, preferred languages, unique device identifiers, serial numbers, browser type, mobile app, file names and types, and plugins.

1.11.3. Purchase data: We collect and retain data regarding the Products you add to your cart, purchases from the Platform, the amount spent on the Platform, and the payment methods used to make purchases on the Platform.

1.11.4. Cookies, log files, web beacons and tracking pixels: We also collect information through the use of “cookies”, “log files”, “web beacons” and “tracking pixels”, and similar technologies to understand how you navigate through the App to learn your preferences. Cookies are small text files that web servers place on your device; they are designed to store basic information and to help websites and apps recognize your browser. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be accessed every time you use the App. Log Files track actions that occur on our Platform, and collect data including your IP address, browser type, internet service provider, referring and exit pages, and date and time stamps. Web beacons, tags and pixels are electronic files used to record information about how you browse the Platform.

 

2. Method and manner of use of User information

2.1. We will also use the User information to enable activities and transactions that need to occur on the Platform, such as:

2.1.1. Generating and maintaining User profiles on the Platform;

2.1.2. Provide personalized features;

2.1.3. Maintaining regular communications with the User concerning transactions the User initiates, such as requesting information or assistance, making payments, etc.

2.1.4. Modifying the Platform from time to time to cater to the User’s interests;

2.1.5. Providing the Platform and the functions and features therein, efficiently;

2.1.6. Preserve social history as governed by existing law or policy;

2.1.7. Fulfill any orders placed for products on the Platform (including processing your payment information, arranging shipping and providing You with invoices and order confirmations, and/or delivering the products to You).

2.1.8. Screen our orders for potential risk or fraud;

2.1.9. Perform internal operations necessary to provide you and improve our Platform, including to troubleshoot software bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyse usage and activity trends.

2.1.10. For improving the Platform.

2.1.11. For creating detailed user profiles. We may combine and aggregate data collected from you on our Platform, through e-mail and other mediums in order to create detailed and wholesome user profiles in order to understand you better and attempt to provide You with better Products, Information, content and services. Please note that the use of any information shared by you through one mode of communication/platform will not be limited solely to that mode of communication/platform.

2.1.12. For research and development. We use the data so collected for research, product development, piloting new products, and improving the UI/UX experience – all of which will ultimately improve how You experience the Platform.

2.1.13. For enabling customer support and communication. We use the information to provide customer support and train our customer service executives. We may further add features that allow You to call us (through the Platform or otherwise), similarly, We may also need to contact You through the Platform.

2.1.14. For marketing and outreach. We use the data we collect to market our products. Such promotion and marketing may be done via hoardings, banners, pamphlets etc.

2.1.15. We use the data we collect to address claims or disputes relating to use of our Platform, or as otherwise allowed by applicable law, or as requested by regulators, government entities, and official inquiries.

2.2. You acknowledge that you are licensing Us to use, modify, display, distribute and create new material from the information you provide through the Platform to render certain services on the Platform. By providing such information, you automatically agree, or promise that the owner of such information has expressly agreed to allow or license, as the case may be, Us to use the information in the manner set out in this Privacy Policy, without the payment of any fees. We may, to the extent permitted by law, also use, license, reproduce, distribute disclose, and aggregate, non-personally identifiable information that is derived through your use of the Platform and you hereby provide consent for the same.

2.3. We shall retain the information You provide to facilitate your smooth and uninterrupted use of the Platform, and to

(i) provide, improve and personalize our Platform;

(ii) contact you about your account;

(iii) give customer service, personalise our marketing communications; and

(iv) prevent, detect, mitigate, and investigate fraudulent or illegal activities. We do not retain your personal data for longer than required for the purpose for which the information may be lawfully used.

 

3. Sharing Of Information

3.1. We will not use User information for any purpose other than in connection with the Platform. We will not rent, sell or share User information and will not disclose any of the User’s personally identifiable information to third parties, unless:

3.1.1. it is pursuant to obtaining the User’s permission;

3.1.2. it is in connection with the services being rendered through the Platform.Please note that We work with third party service providers to execute various functionalities of the Platform, including but not limited to entities such asShopify for e-commerce facilitation, and we may share your information with such service providers to help us provide you with our products, information and other services on the Platform;

3.1.3. it is to help investigate, prevent or take action regarding unlawful and illegal activities; potential threat to the safety or security of any person, violations of Company’s terms and conditions, or as defence against legal claims;

3.1.4. it is a case of special circumstances such as compliance with court orders, requests/order, notices from legal authorities or law enforcement agencies compel us to make such disclosure;

3.1.5. it forms part of the information We share with advertisers on an aggregate basis;

3.1.6. in relation to a change of corporate control such as a restructuring, merger or sale of our assets, we may have to disclose our databases and information we have stored in the course of our operations.

 

4. Information security

4.1. The information provided by the User is stored in access controlled facilities with restricted access. User Information transmitted over the internet is protected through the use of encryption, using the Secure Socket Layer (SSL) or equivalent protocols.

4.2. If a password is used to help protect User accounts and account information, it is the responsibility of the User to keep the password confidential. You have to ensure that You always log out, before sharing the device with a third party and it is advised that the User utilize a service to protect access to the User’s Device.

4.3. We shall use generally accepted industry standards to protect the User information submitted to Us, both during transmission and upon receipt. However, please be advised that, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, even though We strive to use commercially acceptable means to protect User information, We cannot guarantee its absolute security and your use of the Platform is at your sole risk and discretion. We also cannot warrant that such User information may not be misused in the event our safeguards and protocols are breached by a malicious third- party. Further, We are not liable to nor can we fully control the actions of other users with whom you may choose to share your information.

4.4. The collection, usage, and sharing of User information by us shall be in compliance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and other applicable laws.

 

5. Procedure For Removing User Name from the Records

5.1. You have the right to demand us to erase your personal data and we will do so without undue delay, provided that the data is no longer required by Us and there is no legal requirement to retain the data. Do note that multiple legal basis may exist in parallel and We may still have to retain certain personal data at any time, despite your request to delete it.

in to withdraw your consent to any specific data processing. However, please note that, You may not be able to access certain parts of the Platform, as well as certain services from on the Platform if you withdraw your consent. Do note that multiple legal basis may exist in parallel and We may still have to retain certain personal data at any time, despite your withdrawal request.

5.3. You may opt out of receiving promotional and marketing emails from Us by writing to Us. You may also opt out of receiving emails and other messages from us by following the unsubscribe instructions in those messages. Please note that opting out of receiving push notifications may impact your use of the Platform. However, even if you opt out of receiving our promotional and marketing e-mails, We will still send you transactional messages through e-mails about your purchases.

5.4. If and when a User is desirous of having his/her name and other details removed from our records, immediately upon receiving the User’s written request to that effect We shall, subject to the terms hereof, remove and/delete all such information.

5.5. If the User no longer wishes to receive notifications about our Platform, the User may change his/her notification preferences by contacting us at info@krimakay.com 

We reserve the right to close the User account if the User opts out of receiving certain crucial notices that are required by Us to perform the services through the Platform.

 

6. Procedure For Correcting Inaccuracies In User Information

6.1. In the event that any personal data provided by you is inaccurate, incomplete or outdated, then you shall have the right to provide us with the accurate, complete and up to date data and have us rectify such data at our end immediately. We urge you to ensure that you always provide us with accurate and correct information to ensure that your use of our Platform is uninterrupted.

6.2. The User may correct or update any information online. In the event of loss of access details, the User may retrieve the same or receive new access details by sending an e-mail to: info@krimakay.com 

 

7. Right to Confirmation and Access.

7,1.You can seek a confirmation from us as to whether any of your personal data is being or has been processed. If we are processing such data, then you may ask us for summary of such processed data. You also have the right to ask us for a brief summary of our processing activities.
